Part I — Website use

Part II — Service engagement

6. Scope

These conditions govern the engagement of Maccam Network's services through this site or any direct channel (email, meetings, formal proposals). Acceptance of a quote or proposal, or the commencement of work, constitutes acceptance of these conditions. Every service is customized and defined in its corresponding proposal. In the event of any difference, the specific commercial proposal, quote, contract, or agreement shall prevail over these Terms.

7. Formalization, pricing, and payment

Engagement is formalized by accepting a proposal through digital means, electronic signature, or written confirmation. Prices are set out in each proposal, in US dollars (USD) unless otherwise agreed, under the agreed payment terms (upfront, installments, or schedule). Failure to make payment when due may result in the suspension of services until outstanding amounts are settled.

8. Timelines and client obligations

Timelines are estimates and depend on project complexity and on the client's timely delivery of information, materials, and approvals. We are not responsible for delays caused by factors beyond our control. The client is responsible for reviewing and approving deliverables before publication where applicable, for the final validation of content and configurations, and for ensuring that the information provided is accurate and lawful.

9. Results

We guarantee professional performance to high industry standards. Given the changing nature of platforms, algorithms, and markets, we do not guarantee specific results (sales, leads, search rankings, or other outcomes that depend on third parties). Our obligation is to perform the services with professional diligence, not to guarantee any particular outcome.

10. Ownership of deliverables and methodologies

Deliverables created by Maccam Network remain the property of Maccam Network until full payment for the service. Upon payment in full, the client acquires usage rights over the final deliverables, unless otherwise agreed. Maccam Network retains ownership of its methodologies, internal processes, tools, templates, frameworks, know-how, and any other intellectual property used to perform the services. Maccam Network may feature completed projects in its portfolio and promotional materials, unless a confidentiality agreement provides otherwise.

11. Cancellations, pauses, and refunds

Given the customized nature of the services, once a project has started there is no right of unilateral withdrawal without compensation for the work performed. Pauses must be requested in writing and do not interrupt the agreed payments; reactivation may carry a replanning surcharge. Scope changes are quoted separately. 12. Confidentiality

Both parties agree to keep confidential all information exchanged during the project (strategies, data, internal documents). The confidentiality obligation shall remain in force even after the business relationship ends.

Common provisions

13. Force majeure

Maccam Network shall not be liable for delays or failures to perform resulting from circumstances beyond its reasonable control, including supplier outages, third-party services, digital platforms, natural disasters, labor disputes, infrastructure failures, or similar events.

14. Modifications

We may update these Terms to reflect legal, technical, or service changes. The current version is published on this page and applies from the date of publication.

15. Governing law and jurisdiction

These Terms are governed by the laws of the State of Florida, United States. Any dispute shall be submitted to the competent courts of Miami-Dade County, with the parties waiving any other forum. Nothing in these Terms limits any mandatory rights granted by applicable law where such rights cannot legally be waived.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, that determination shall not affect the remaining provisions, which shall continue in full force and effect.
